I'm already speaking with attorneys......

Just to be clear, if you are already talking to an attorney, have you or someone you know been injured and help was delayed because of the phone or are you contacting an attorney because something might happen?

You see, one of the things that the folks on this board maybe suspicious of is someone looking for a payday by drumming up others for a class action thing.  If you've been harmed that's one thing but trolling for lawsuit dollars is another...

True, and FWIW I hope whover is seeking attorneys are looking out for the consumers, not looking for dollars.  Most lawsuits happen because something has happened (injury, scam, etc etc etc) but this is a huge liability to HTC these things are supposed to work right? VoIP providers have to put out a disclaimer that VoIP should not be used for 911 calling and if they do to make sure their E911 info is current to their location if HTC had such disclaimer that says something like "911 calling will be intermittent, don't expect help" discliamer maybe... I dunno then I'd say they have a valid reason but they edon't.

I don't have my EVO yet, and I don't plan to test it out I just hope it works.

See, the funny thing about that is that people who go into a class action looking for money end up not getting much of anything. The named plaintiffs (those whose names are on the suit) end up getting about $100, if that. Everyone else in the class usually gets a small coupon of some sort from the company. The lawyers get the vast majority of money, which pisses a lot of people off but in actuality, they do a LOT of work on class actions with no guarantee of any money because if they lose, they get nothing. Class actions usually take 3-5 years, sometimes more, to settle or go to trial and during that time, the attorneys are getting nothing, but have to put in a lot of time and expense into investigating the suit, doing discovery, spending inordinate hours going over the documents obtained in discovery, going to numerous hearings, etc. And they have to justify the hours and expenses to the court before they are allowed to recover any money from settlement or trial, and are limited to charging what's called a lodestar, a set amount that they can charge for their time. I speak from experience here, having worked on quite a few class actions.

So yeah, anyone looking to sue a big company with deep pockets in order to get a big payout is barking up the wrong tree if they go the class action route.

I searched for this topic because this issue made it to my local news chanel
 Channel 9 fox news, minneapolis(or it may have been KARE11). A report of a victim of a mva who was unable to call 911. She in fact demonstrated on tv how the evo rebooted when she dialed 911. This is a serious concern. We disconnected our landline after we got 2 evo's. We have taught our 6 y/o how to dial 911 in case mom and dad are unable. We now cannot trust this is safe. We may need to get the landline back for that reason only.
If we make our concern clear hopefully htc will release a fix.

Once again, I would LOVE to test this but don't want "the man" knocking on my door.  If this is a problem I can't see how it isn't an easy fix as it has to be a software bug of some form. 

It's hard to know if the reports we've seen are true or if they are more of an urban legend kind of thing.

I think what I might do is call my local news outlet and ask them if they can arrange a test.  I'd imagine they'd be interested in a story like this and would have the connections to test it.

I just called and told them I had misdialed, that I didn't have an emergency. She just said "Ok, thank you." I had no problem with the phone rebooting or anything, it dialed right to them. However, I do use PhoneTell, not the regular phone dialer, so that might have something to do with it.

It has a built-in call assistant so that if I'm busy and/or don't want to talk right now, I can push one button and send an SMS saying I'm busy or whatever. Also has a built-in directory search, which makes it easy to call places like the nearest Pizza Hut without having to have their number in my contacts. I can also turn on the Do Not Disturb feature and have it auto-respond with a message that I can't answer right now, have the DND turn off automatically after a set amount of time, and I like the call log better.

Oh, and I can call 911 if I need to. B)

It worked fine, no issues... and the phone automatically turned into "Emergency Mode" for 5 minutes. It turned the GPS (the only thing I noticed).

Now I feel much better knowing i can count with it in case of emergency... i will also test it next time I see an accident in the street... it will give me a legitimate excuse to call them!

OK, this is really beginning to look like it's either an urban legend or someone is trying to harm Sprint/HTC/Google by creating a myth.  I would really like to see Sprint/HTC step up and make an official and public statement about this as it would be in there interest, and ours, to let everyone know if there is or isn't a problem.

I could see how a fanboy for Apple, for example, could start a rumor like this, but I don't know for sure.

It appears from this link that an actual news outlet contacted Sprint and HTC about the issue and got an uncertain response from them -- not good.

One of the guys that gave a response, glenn75, made an interesting comment about the way the phone may react to an unexpected response from the 911 center.  If this is like the issue HTC had with the Dream in Canada then they apparently didn't learn very much from it.

So, it appears to me the problem is real but will not effect everyone because it requires a certain 911 system to trigger the problem.  If the problem reported in Minnesota is tested by HTC and Sprint, in Minnesota, in the area where the problem happened they should be able to log the messages and then duplicate the problem.  However, if they only test in areas that do not have a problem they will never find it.

Sprint and HTC, go to Minnesota to the place the problem occurred and test where the problem happened.

I live in Miami, FL... extreme road rage (probably highest in the country)  and the drivers here are very "creative".

On my way to work, which is a 6 mile drive; I see some form of accident/fender bender at least 3 times a week.

One day about a year ago, I saw 2 crashes a block away from each other. At the next light, i see a pickup truck t-bone a large suv (i think it was an expedition). Then I got on the express way, and about 300 feet ahead of me, I see a car cutting off a landrover and witnessed it losing control, flipping and rolling over a few times.

I actually didn't go to my destination and stopped by my mom's house that day and just stayed there a few hours until all the mayhem from that day passed...

We got beautiful beaches, girls, weather and places to go... but horrible drivers! Embarrassed

I have family in the Stuart area, well actually Hobe Sound which is half way between Stuart and Jupiter and is therefore known as Stupiter.  I have visited FL many MANY times over the years.  Given the high number of retired people it's not hard to see someone drive for miles with the turn signal on and the only thing you see from the back is the knuckles on the steering wheel.

Oh yeah, you can keep the summer weather!  wink
